Terms Of Use

For good consideration and use of the Stolen-Property.com.com and List-Of-Property.com.com sites, you are acknowledging that you have read, understand, accept and will comply with the Terms of Use listed below.

1. Definitions

A. “Web sites” refers to Stolen-Property.com and its sister site List-Of-Property.com.

B. In certain contexts the word “web sites” may also refer to / include the company which owns the web sites, as well as include some or all of its members, employees, contractors, beneficiaries, assigns, and agents.

C. “Our” and “we” may also be used, on occasion, to signify the company which owns and web sites, as well as include some or all of its members, employees, contractors, beneficiaries, assigns, and agents.

D. “You” and “Your” refers to an individual, company, or third party who registers for web sites and/or uses the web sites either to post stolen property, to list their property, or to search the web sites database in order to discover if a piece of property has been reported stolen on web sites.

E. “Listing” refers the information, associated with a particular piece of property, entered by you into web sites’ database.

F. Plural words shall include the singular, and the singular shall include the plural

G. Neuter gender shall include the male and female as well as a trust, firm, company, or corporation, all as the context and meaning of this agreement may require.

2. An Overview Of Terms of Use

A. After agreeing to the web sites’ Terms of Use and entering the required registration information, you will be issued a user account.  You may then access your user account with your username and password.

B. You agree to use the web sites solely for their intended purposes.  These purposes include:

• the listing of a piece of property which you rightfully own;
• listing a piece of property, which you rightfully own and has been lost by, or stolen from, your possession;
• searching the database by entering manufacturer, model, and serial number in order to determine if a specific piece of equipment has been reported stolen on web sites;
• and/or you are a third-party who is rightfully granted access by the account holder for whatever purposes (legal, insurance claim, etc.).

C. The laws of your country, state, county, city, township, or village may prevent you from entering into a legally binding contract and, as a result, agreeing to the legally binding Terms of Use in order to create a user account for web sites. By agreeing to the Terms of Use, and creating a user account, you are claiming you have no legal restrictions and can enter a legally binding contract.  This inability to enter into a legally binding contract includes, but is not limited, to minimum age requirements to enter into a legally binding contract.   In such a case your parent or guardian must create a user account.  

D. If you create or operate a user account on behalf of another individual, you are hereby declaring to web sites that you have been authorized by the individual to do so.  By agreeing to the Terms of Use and creating a user account you are declaring that you have the authority to enter into a legally binding contract on behalf of the third-party individual.

E. If you create or operate a user account for a company, you are hereby declaring to web sites that you are an authorized representative of that company.  By agreeing to the Terms of Use and creating a user account you are declaring that you have the authority to enter into a legally binding contract on behalf of your company.

F. You understand that all information (contact information, URLS, emails, addresses, information regarding a piece of property, etc.) and photos entered or uploaded on the web sites are the sole responsibility of the company or individual who entered or uploaded said photos or information on the web sites.  By using web sites you understand and agree that you may be exposed to inaccurate, objectionable, offensive, misleading, or otherwise objectionable listings information, or photos.  Web sites’ members, employees, contractors, beneficiaries, and assigns make no representation or warranty of the listing.

G. In the event a piece of listed property is lost or stolen, web sites’ owners advise you to not enter your personal contact information for that specific listing.  We advise you to only enter the contact information for the police department where you made the police report for the lost or stolen piece of equipment.  When the police, or proper law enforcement authorities, are directly contacted, they can then initiate the appropriate response, and contact you using the information you’ve entered on your police report.   If you do chose to enter your personal contact information on a stolen property listing, we advise you to contact the police or appropriate legal authority immediately after being contacted by someone who has searched and discovered that your property has been reported lost or stolen, and has information regarding the property’s whereabouts.  Additionally, web sites’ owners advise you not to give additional personal information to, or initiate a meeting with the person contacting you, in an attempt to directly recover your lost or stolen property.

H. You agree to indemnify and not hold liable the web sites, its members, subsidiaries, affiliates, employees, contractors, successors, assigns, officers, directors, beneficiaries, and agents under any circumstances including legal claims, attorneys’ fees, loss, damage, or criminal acts of any kind which may occur as a result of the contact information entered on web sites, links to others sites, the private information you provide to web sites or on listings, correspondence initiated due to the creation of a listing, or correspondence with someone who has created a listing.

I. Web sites’ owners grant you access to web sites for your own personal use after you have agreed to the Terms of Use and entered the appropriate information to register and create an account.  This access does not include:

• any collection, duplication, or any other derivative use of information on photos on web sites;
• using, or cause a third party to use, contact information listed when searching the web sites’ database for a specific item, other than using the contact information for the purpose for which it was intended;
• the misuse of information including intellectual property violations, using information for spam mail or solicitation of any kind, copying text, copying codes, mimicking database storage and use, imitating marketing techniques, etc.;
• any use of spiders, robots, or other similar data gathering tools or programs;
• and use, duplication, or collection of any information, photos, graphics, site layout, site design, programming code, etc. for any purpose other than the purposes outlined in clause 2.J.

J. Web sites’ owners are willing to allow the following exceptions to clause 2.I:

• search engines and non-commercial public archives can use robots, spiders, data mining tools to amass, copy, or duplicate information for the sole purpose of ranking URL's and providing links to the web sites;
• you may display on your web site, or create a hyperlink to the home page of web sites so long as the link does not portray web sites, its owners, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive matter;
• and if you wish to copy, collect, reproduce, or make derivative use of any content displayed on the web sites for any other purposes (including commercial purposes) not stated herein, you must first obtain a license from web sites’ owners.

K. The web sites, its database, and associated services detailed herein are provided to you "as available" and “as is”.  All implied or expressed warranties  including, but not limited to, the reliability, security, timeliness, accuracy, and performance of the web sites are disclaimed by web sites to the fullest extent permitted by law.

L. The web sites disclaim, to the fullest extent permitted by law, any warranties for other services or goods advertised on the web sites, or accessed through any links or URL's on the web sites.

M. The web sites disclaim, to the fullest extent permitted by law, any warranties regarding protection from viruses or other harmful components in connection with the web sites or other sites, connected to the web sites through advertising, etc.

N. By registering for web sites, you understand, accept, and agree:

• that you will not compete with web sites for a period of 2 years;
• that you will not indirectly or directly disclose or provide information (data entry techniques, data, information, web site or page layouts, functions, buttons, URLS, programming, services, etc) to a third-party who is, intends to, or will compete with web sites;
• and you will not or cause a third party to, directly or indirectly hire, solicit, or encourage to leave the web sites’ employment, any employee, consultant, or contractor of the web sites or hire any such employee, consultant, or contractor who has left the web sites’ employment or contractual engagement within a two-year period.

O. These agreed to Terms of Use shall be construed and enforced in accordance with the laws of the State of California.  If any provision of this agreement is determined by any court of competent jurisdiction to be illegal, invalid, or unenforceable to any extent, or in violation of any applicable law, that provision shall, if possible, be construed as though more narrowly drawn, if a narrower construction would avoid such invalidity, illegality, or un enforceability or, if that is not possible, such provision shall, to the extent of such illegality, invalidity,  or un enforceability, be severed and the remaining provisions of these Terms of Use shall remain in effect.

P. Our failure to act with respect to a perceived breach by you or any other user of the Terms of Use does not waive our right to pursue legal action to similar breaches, either in the past or future, by you or other individuals.

Q. By registering for web sites, you understand, accept, and agree to the Terms of Use.  Furthermore, these Terms of Use may be updated occasionally at our sole discretion, and each time you log-in to the web sites you are agreeing the to latest version of the Terms of Use.  If you disagree with any of the Terms of Use, at any time, your only option is to not use or discontinue the use of the web sites.

R. Your acceptance and agreement to the Terms of Use constitutes the whole and entire agreement between you and web sites.  This acceptance and agreement replaces and supersedes all prior written and oral agreements.

3. Web Site Owners’ Rights

A. Web site owners may litigate against, pursue and/or file criminal charges, moderate the information within a listing or account, delete an account of listing of any user of the web site for any reason, including, but not limited to a perceived or actual violation of the Terms of Use or the spirit of the Terms of Use. Additionally, you agree that you will not try to circumvent the web sites’ decision by reentering the deleted information, modifying the web sites’ changes to said information, or creating another account without the express written consent of web sites.

B. You understand that web sites’ owners, employees, contractors, etc. can, at anytime, modify or discontinue, some or all of the web sites information, site maps, or programming, with or without notice, and that web sites in doing so will not be liable financially or otherwise, to any individual, company, or third party if web sites are modified or discontinued in such manner.

4. Final Note

Every time you access the Stolen-Property.com or List-Of-Property.com Sites either as an unregistered visitor or you are logged in as a registered user, you are agreeing to our current Terms of Use. These Terms of Use can change at any time without any notice. It is your own personal responsibility to know the most current Terms of Use by reviewing our posted Terms of Use on this page. If you do not agree with our Terms of Use, they are non-nogotiable and you should discontinue all use of the Stolen-Property.com and List-Of-Property.com Sites immediately.
